La ricerca storica sulle polizie e sul controllo del territorio negli ultimi anni si è focalizzata in larga misura sulle pratiche, sulle culture e in genere sul mestiere.  Questo profilo di studio, che ha necessariamente stimolato le ricerche di base, ha anche messo in evidenza quanto sia limitativo approcciare questi temi radicandosi al piano normativo e profilando grandi modelli interpretativi. Le polizie, se è lecito chiamarle così anche per l’antico regime, sono apparati o istituti che per loro natura vivono e operano nello spazio che connette il potere con la società. Il ventaglio amplissimo dei compiti rimanda sempre ad alcune costanti: le polizie devono vigilare all’affermazione di valori e interessi prodotti dall’alto, difendendo l’ordine sociale dai comportamenti illegali. Per fare ciò devono operare a contatto della società e se a certi livelli il loro agire deve muovere entro binari formalizzati, ad altri livelli la priorità del fine da raggiungere fa sì che esse ricorrano, e sia loro concesso ricorrere, a strumenti e pratiche che consentano la necessaria rapidità ed efficacia. E così a livello operativo, di composizione di corpi, di saperi pratici si deve necessariamente fare riferimento, studiando le polizie, a una dimensione nella quale il piano formale e quello consuetudinario si mescolano in modo importante, e in cui spesso pratiche, saperi e uomini che vengono dal profondo contraddicono anche in modo marcato ciò che gli indirizzi politico-amministrativi e normativi avrebbero voluto affermare. Le pratiche di disciplinamento e controllo del territorio divengono, in questa prospettiva, un potente strumento per analizzare la poliedrica dimensione del soggetto giuridico e della sua relazione con le dimensioni del governo e della partecipazione politica, rifuggendo la ricerca di una artificiale uniformità interpretativa.

Se per l’antico regime queste condizioni sono intuitivamente comprensibili, dall’età napoleonica in avanti, e in particolare con riferimento allo Stato liberale, la forza del costituzionalismo e del positivismo giuridico fanno velo a questa compromissione di piani, specie quando la soggiacente dimensione corporativa della società si ammanta di un lessico formalmente nuovo, facendo del tecnico il presunto momento a-politico del potere. L’ossequio formale a determinate categorie diviene il principale strumento attraverso cui riportare vecchie pratiche nell’alveo rassicurante dello Stato di Diritto: si pensi solo alla formalizzazione dell’informalizzabile, come appunto è stato fatto creando lo spazio delle indagini sotto copertura. A guardare con attenzione si vede che questa doppia dimensione delle polizie si riconosce anche dall’Ottocento in avanti, in modo analogo a quanto è dato riconoscere nei tentativi di ridefinizione delle modalità di controllo del territorio in antico regime e financo nel medioevo.

L’incontro si propone di esaminare, sul lungo periodo, casi che illustrino questo gioco di permanenze e di adattamenti che sottostanno alle discontinuità indotte da modifiche nelle filosofie e negli assetti di governo. Solo per proporre qualche esempio, si può fare riferimento agli inevitabili contrasti ed eredità che la creazione di nuove polizie porta con sé: si guardi ai mille problemi che accompagnano la creazione delle gendarmerie, che devono confrontarsi con selezioni di uomini, assunzione di carichi economici e altro che si traducono in molti casi in compromessi con un passato che si sarebbe voluto superare. Oppure, sul piano delle pratiche, meritano di essere analizzate le modalità spesso ambigue e a debole regolamentazione dell’utilizzo di reparti di linea con compiti di polizia, spesso strumento, per l’autorità civile, per aggirare vincoli di natura giuridica e oggetto di più o meno sotterranei conflitti con l’autorità militare. Ambiguità che, dipendendo dai contesti, si traduce nella perdurante ricerca di legittimazione della dimensione corporativa dei protagonisti civili e militari del governo. Ma infiniti altri, e su momenti cronologici diversi, possono essere gli spunti di riflessione.

L’incontro di studi, che si inserisce nell’ormai ventennale attività convegnistica del CEPOC (www.cepoc.it), si terrà nell’incantevole sede di Palazzo Feltrinelli a Gargnano del Garda il 19 e 20 ottobre 2018. Si prevede l’arrivo dei convegnisti nella serata di giovedì 18 ottobre e la chiusura dei lavori col pranzo di sabato 20. Per chi arrivasse con i mezzi di trasporto a Milano o nei suoi aeroporti (Linate, Malpensa, Orio al Serio), nei limiti del possibile si offrirà un passaggio in auto per raggiungere la sede del convegno. L’organizzazione si farà carico delle spese di vitto e di alloggio, mentre potrà farsi carico delle spese di viaggio solo in casi particolari.

Il seminario prevede una prima giornata (venerdì 19) interamente dedicata alla presentazione di relazioni, mentre la mattinata del sabato sarà dedicata alla libera discussione tra tutti i partecipanti. Si potrà prendere parte al seminario sia in veste di relatore e discussant, sia di solo discussant. La partecipazione sarà sia a inviti, sia tramite call for paper. Al proposito si valuteranno proposte di partecipazione accompagnate da titolo della comunicazione e relativo abstract (da inviare a livio.antonielli@unimi.it o a giacomo.demarchi@unimi.it entro il 31 luglio 2018).

In recent years, longitudinal studies into the police force and territorial control have focused principally on practical and cultural aspects, as well as on the routine workings of the force.  This line of inquiry, of necessity, acts as a stimulant for basic research projects. It also shows the limitations of an approach that is confined to a purely prescriptive level while simultaneously foreshadowing large-scale interpretive models.

The police force, if we may call it so also in reference to the ancien gime, is an agency, or institution, which by its very nature, exists and operates within a space that connects state power with society.

The vast range of its tasks consistently revolves around certain constants: the police must be vigilant in upholding the standards and agendas generated from above, and in defending the social order from unlawful behaviour.

In order to achieve this, they must maintain a strong societal presence. In some areas their modus operandi implies an adherence to textbook directives, while in other areas the priority of achieving an objective may necessitate their resorting to tactical measures that will result promptly and effectively in the desired outcome.

Consequently, in researching the police force at the operational level, and in relation to recruitment, composition and practical expertise, reference must necessarily be made to an area in which prescription and modus operandi are significantly mixed, and where practices, expertise and officers at the grassroots level are sometimes in marked contrast with the prescriptions of would-be political and administrative principles.

From this perspective, the practical aspects of territorial governance and control become a powerful instrument for analysing the multifaceted nature of a citizenry consisting of legal entities, and its relationship with the arms of government and its political involvement, while avoiding the search for a contrived interpretive uniformity.

In the case of the ancien régime, these conditions can be intuitively grasped. However, from the era of Napoleon onward, with particular reference to the Liberal State, the powers of constitutionalism and legal positivism have obscured the above scenario. This has been based on compromise, especially when the underlying “corporative” aspect of society dons the mantle of a formally new lexicon, and the technical aspects allegedly become the apolitical face of power. Formal lip-service to some defined categories thus becomes the main instrument through which old customs are brought back into the comforting fold of the Constitutional State: we need only to think of the legitimation of what should be illegitimate, as in the authorization of undercover investigations.

Careful consideration reveals that this double dimension of the police force can be recognized from the 19th century onwards, similar to the way in which we can identify attempts to redefine the forms of territorial control in anciens régimes, including even the Middle Ages.

The conference is designed to examine, over an extended period of time, specific cases that highlight the interplay of permanencies and adjustments underpinning the discontinuity caused by changes in the philosophy and structures of government.

Solely to quote some examples, we may refer to the inevitable conflicts and legacies brought about by the creation of a new police force and the innumerable problems associated with it. These include, among others, issues of recruitment and financial obligations that often result in compromises with an historical background the authorities would have preferred to leave behind.

Alternatively, in a practical context, we would need to assess the often-ambiguous “soft” protocols concerning regulations for the employment of military units with policing tasks. These often become an instrument used by civilian authorities to circumvent legal obstacles and a trigger for more or less hidden conflicts with the military. It is an ambiguity, depending on context, that can form the basis for an ongoing search for legitimation of the “corporative” dimension of civilian and military authorities in government. However countless other stimuli for reflexion can be found, in various chronological phases.

The conference, one of a 20-year-old series of CEPOC meetings (www.cepoc.it), will be held at the charming Palazzo Feltrinelli in Gargnano del Garda on 19 and 20 October 2018. Participants are invited to arrive on the evening of Thursday, 18 October and remain for lunch on Saturday 20 October. Those travelling to Milan by public transport, or flying into the nearby airports (Linate, Malpensa or Orio al Serio), will, wherever possible, be met and transported to the conference venue by car. Meals and accommodation will be provided by the organizing committee. Travel costs will be met only in certain specific cases.

Day One (Friday 19th) will be entirely devoted to individual contributions. Saturday morning will be devoted to a free-ranging discussion involving all participants.  You will be able to participate both as speaker and discussant, or alternatively as discussant only. Attendance will be either by invitation or through a call for papers. Proposals for papers should bear a title and be accompanied by an abstract (send to livio.antonielli@unimi.it or to giacomo.demarchi@unimi.it, by no later than 31 July 2018).

Techniques of Identification and Individual Rights

MaTriX laboratory proposes to be an opportunity for discussion and reflection open to young historians, sociologists, political scientists, jurists, and social psychologists whose research focuses  on institutions. To this end, MaTriX removes every chronological and thematic barrier: although focused primarily on topics concerning political European modernity, the laboratory does not apply  spatial and temporal limits to its contributors,and follows an interdisciplinary approach. MaTriX aims at promoting a new order of discourse in the social sciences: institutions as key to interpreting the socio-cultural, political, and economic reality.

 

Today’s migration to Europe involving hundreds of thousands of individuals certainly does not represent an extraordinary and unexpected phenomenon. Yet, this migration places matters of great importance at the centre of the political debate. One of these, the topic of people’s identification, has acquired a growing importance within the political agenda of many European states as well as the European Union. The need to ascertain the identity of migrants basically accomplishes two objectives: on the one hand, it contributes to the control of the territorythrough the detailed knowledge of the individuals who live within it; on the other hand, it makes those individuals legal subjects incorporated in a system of laws and administrative regulations. Therefore, the identification of migrants has a highly political significance and it is an extremely ambivalent activity, since it is the demonstration of a power that is exercised first and foremost on the migrants’ bodies by such means as the collection of fingerprints, photographing their faces, and the verification of their name and birthplace.

The processes and mechanisms of identification for managing migration carried out by the states and supranational organizations have aroused a lively cultural and political debate. The security devices employed to govern people’s movements have a strong impact on western societies, both for the effects produced by the emergency rhetoric used by the governments of the host countries, and for the effects that these security startegies inevitably have on immigrants. Thus, theoretical reflections and empirical research constitute ex parte principis: namely, they have to analyse the kind of sovereignty in the matter of identification that is exercised by national and supranational political actors and the security discourses they resort to in order to legitimise legal and technical tools for migrants’ selection. But, at the same time, research and reflections need to be ex parte populi, which means focusing on the rights –for instance, to privacy and freedom of movement –of the individuals who are subject to identification processes.

Within the literature on identification, as efficaciously highlighted by Buono, there are two different main approaches: the first one, which is strongly influenced by the works of Foucault and Weber, is focused on identification as a surveillance activity pursued by states, while the second one, which is more linked to the experiences of non-western countries, is centred on the notion of registration as a form of recognition of membership and as ameans of gaining access to rights.

The presence of these two paradigms shows the ambivalence of identification, thus stressing the great political and scientific relevance of this topic. On the one hand, the act of registering is a device for monitoring that satisfies the need of knowing and thereby an activity that is functional to the creation of more effective policies, but, on the other hand, it is a powerful tool of social control, based on the monitoring of territory and the identification of the individuals who live within it.

MaTRiX Laboratory’s third call for papers focuses on the theme of Identification techniques and individual rights with a long-term perspective -starting from the Middle Ages to the present day. The new volume, edited by Simona Berhe and Enrico Gargiulo, will welcome contributions by scholars from many diverse fields: sociology, law, economics, computer science, geography, history, anthropology, medicine and genetics, and demography.

Some examples -neither exhaustive nor binding -of areas of knowledge and relevant topics that can be addressed:

  1. The legal changes relating to the identification issue;
  2. The administrative registration procedures and their political significance;
  3. The technical tools for identification and registration;
  4. The technologies for the collection and processing of personal data, also considering the importance covered by the theme of big data;
  5. The medical, physiological, and genetic bases of the use of biometric data;
  6. The role of statistics and demographic sciences in building a shared knowledge on the registration issue;
  7. The institutions involved in the registration procedures and their role in relation to political actors and their objectives;
  8. Subjective strategies (and collective)of resistance to the identification process, with particular reference to the Dublin Regulation.

Each author must send the ANNEX A (download here), completed and signed, to thee-mail address fingerprints.labmatrix@gmail.comby October 31, 2016. Contributions will be allowed in Italian, English, French, Spanish, and Portuguese. The selection results will be announced by December 30, 2016.

Each author is given six months to write their own contribution (max. 35,000 characters including spaces), which will then be subject to a peer review. The selected papers will be discussed in a special workshop to be held at the University of Milan in November 2017. Next, the researchers involved will have an additional month to make corrections and/or suggestions arising from the workshop. The book will be published by spring 2018, and presented and discussed in the annual seminar of the MaTRiX Network in June 2018.

MaTRiX, which will publish the volume and organize the workshops, is a non-profit association that is totally financed by the quotas paid by its members. Therefore, as a contribution to the success of this work, if their abstract is accepted, each author will be required to pay a fee which is to be paid into the account of the MaTRiX Association.

In order to cover part of the publishing and organizational costs, this amount should be paid before March 31, 2017 in the following ways:

(A) Doctoral / PhD students without a scholarship: € 30.00;

(B) Doctoral / PhD students with a scholarship: € 50.00;

(C) Professors: € 70.00.

POLICE EFFECTIVENESS: the stationing on territory and the wage policy

 

In the policing and police history literature, rich by now, surely there has not been a lack of attention towards spatial organization.  I am referring to numerous studies published in the recent past. The administrative divisions and the control logics that accompanied this process of definition and organization of spaces, with a specific focus on the period of eighteenth-century reforms, have been widely analysed. However, while these studies have generally highlighted the rationalising function related to the project and the realization of these administrative units, they have not drawn the same attention to the stationing on territory of people concretely responsible for control duties. This is even truer if the chronological perspective of observation is diversified and extended.

Therefore, the next workshop organized by Cepoc (see www.cepoc.it for the complete list of precedent seminars), planned in Gargnano, on Garda Lake, the 21st and 22nd October 2016, is going to be about this subject. In particular, we want to draw the attention to what was, and in obedience to which rationales, the presence on territory of policing forces and policing men, with the aim of reconstructing their location, the changes over time and the reasons that preside and presided over the various choices. Où aller pour ne plus trouver de gendarmes, se lamente George Sand, en 1841 ? Pas dans la centaine de pays du monde où une gendarmerie a été créée sous différents noms, depuis la fin du XVIIIe siècle, après la sortie de cette institution de son berceau français !

Quelles sont les péripéties de cette expansion, entre importation forcée et choix délibéré, imitation et réinterprétation, hybridation et suppression ? Comment la gendarmerie française, organisatrice d’une trentaine d’institutions, les Carabinieri, la Guardia civil et les autres corps européens y participent-ils ? Que retient-on d’un « modèle gendarmique » qui est parfois transformé en libre-service ? Que nous apprend cette diffusion d’une police à statut militaire sur les représentations dont elle est l’objet, ses fonctions multiples et les interrelations entre l’armée, l’État et la société ?

Cet ouvrage a été élaboré, notamment, à partir des communications au colloque organisé par l’Université Paris-Sorbonne (Centre d’histoire du xixe siècle) et la Société nationale de l’Histoire et du Patrimoine de la Gendarmerie. Il propose une longue synthèse détaillée, 20 études de cas, un tableau synoptique de 98 institutions, 72 notices, des statistiques par continent et une carte de l’état des lieux en 1939 et 2015. Il élargit l’histoire, comparée et connectée, des systèmes policiers, qui ne sont pas seulement composés d’institutions à statut civil et de corps baptisés, confusément, « paramilitaires ». Il enrichit l’histoire des constructions étatiques et impériales, des relations internationales, de la colonisation et de la décolonisation, ainsi que celle des politiques de sécurité depuis la fin du xxe siècle.

La storiografia su polizia e controllo del territorio da qualche anno sta focalizzando la propria attenzione sulle concrete modalità attraverso le quali, nelle diverse epoche, lo stato, le comunità, la società civile cercavano di fronteggiare le minacce interne e rendere effettivo il controllo del rispettivo territorio.

Lo studio delle polizie, in tutte le possibili forme organizzative, è ovviamente al centro di questa riflessione. Tuttavia una delle forme di difesa più significative è certamente quella che vede per protagonista la stessa società civile, attraverso modalità consuetudinarie di intervento. La storiografia si è spesso interessata a queste forme di difesa, ma quasi esclusivamente con riferimento agli aspetti che più sono accostabili all’organizzazione di difese militari o para-militari: faccio riferimento alle milizie in tutte le loro forme, a presidi, strutture d’avvistamento, controlli confinari e sanitari, alle mobilitazioni più o meno organizzate al suono delle campane a martello e così via. Molto ai margini, invece, è rimasto lo studio delle numerosissime figure, presenti ovunque e in ogni epoca, cui erano demandate specifiche operazioni di controllo, vuoi per garantire la sicurezza dei traffici, vuoi per combattere la delinquenza, vuoi per garantire dai contagi, vuoi per disciplinare l’attività agricola, la navigazione e via di seguito.
